A man from Binga approached a traditional chief’s court and demanded three cows and 15 goats from his cheating wife and her alleged lover after he found out about their claimed affair, it has emerged.
The man, whose name was not given before a Hwange court last week, was eventually paid three beasts and nine goats after Chief Siachilaba, who presided over the trial of Besai Ngwenya, 32, and Winnie Ngwenya, ordered that they compensate him.
Chief Siachilaba ruled that Ngwenya pays two cows and seven goats, while Winnie paid her husband one cow and two goats for cheating on him.
Winnie, whose husband was based in Hwange town where he works, initially denied having an affair with Ngwenya when her husband, who had been tipped by neighbours, quizzed her.
A report was made at Chief Siachilaba’s court after Ngwenya later confessed to having had sex with Winnie, but the woman later claimed she was raped. In a bid to save her marriage, Winnie then reported a case of rape to the police, resulting in Ngwenya’s arrest.
The charges were however, withdrawn before plea after she later changed her mind and deposed a withdrawal affidavit, blaming her husband for influencing her to fake rape charges.
“Sometime in March I reported a case of rape against Besai Ngwenya. I did so to save my marriage since I was forced by my husband to lie against the accused person.
“However, I have decided to tell the truth because I didn’t have sex with the accused and wish to withdraw the charges,” said Winnie in a withdrawal affidavit.
Prosecutors had told court that on an unknown date in March, Ngwenya went to Winnie’s homestead where he allegedly confessed being attracted to her because of her beauty.
“On the same day at night Ngwenya went back to the woman’s homestead and sneaked into her bedroom hut after forcing open an unlocked door, before sitting on the bedside,” said prosecutor Memory Munsaka.
Scared by the sight of a stranger, Winnie allegedly jumped from the bed intending to flee, but Ngwenya blocked her and threatened to hit her with an axe he was carrying if she made any noise. The court was told that Ngwenya pushed Winnie to the bed where he allegedly pinned her with his knees.
“He closed her mouth with his hand and had sex with her once after wearing a condom, said the prosecutor.
It is alleged that sometime in April Winnie was going to fetch water when she met Ngwenya along a path and he dragged her into the bush asking her when her husband was returning home. Winnie allegedly lied to him as she feared he would return to rape her again
“Later in the month, the complainant’s husband returned home and quizzed her about the alleged affair and she vehemently denied,” said Munsaka.
The husband reported the case to Chief Siachilaba after a family meeting failed solve the matter.
